This Greater China General Privacy Policy applies to all personal information collected by Swarovski (Shanghai) Trading Co., Ltd. and its related legal entities (“Swarovski”), including but not limited to, by way of the Website, and explains how we process personal information and comply with the requirements of applicable personal information protection laws.

In principle, we do not knowingly collect and process personal information from minors under the age of 14 (“Children”) without the consent of their parents or other guardians. 

If you are a child under the age of 14, you should only use this Website accompanied by your parent or other guardian and should not provide any personal information to us. If you must provide us with your personal information, please make sure that your parent or other guardian reads this Privacy Policy carefully and that you use our Website, products and/or services with the consent of your parent or guardian.  

If you become aware that we have collected personal information from any child and you, as his/her guardian, intend to exercise your rights, you may do so in the manner described in Section 8 of this Privacy Policy. 

If there is any inconsistency between this Privacy Policy and the privacy policies specific to the SCS or Swarovski Club programs or other membership programs, this Privacy Policy shall prevail.

We collect personal information from customers (existing and prospective), suppliers, contractors, prospective employees, and consumers and other individuals for various business and other purposes listed below. In this section, we describe the types of personal information we usually collect and how we collect such information.

The types of information Swarovski may collect from you will depend on the circumstances in which that information is collected. It may include, for example, your contact information (such as name, email address, address, telephone number), date of birth, gender and where necessary to effect a purchase, pre-order, return or similar transaction, your credit card or banking details.   

In particular, Swarovski may collect personal information: 

    when you contact us or our retailers with inquiries or questions;

If you do not provide Swarovski with all necessary personal information, we may be unable to assist you or provide you with our products and/or services, you may not be able to participate in our promotions or competitions or you may be unable to join the SCS, Swarovski Club (or similar membership groups).

If we receive information about you from someone else (for example from someone who supplies goods or services to us), we will ask that person to ensure that the source of such information is lawful and will take reasonable steps to ensure you are aware that we have collected personal information about you and the circumstances of the collection.

3.    Our Use of Cookies

Swarovski uses Cookies to make your use of the Website, resources and services as convenient as possible. -    We will entrust a logistics service provider to deliver the products to you, in this case we will collect information such as the recipient’s name, contact information, detailed delivery address, remarks or messages (if any) as well as the amount to be collected on our behalf (if any); 
-    If you make payment to us through a third-party payment agency, such as UnionPay, Alipay or WeChat Pay etc., your payment information will be processed directly by such third-party payment agency rather than by us, and only that third-party payment agency will obtain your payment results; 
-    respond to inquiries from existing and prospective customers seeking information about our products or services: we will collect your title, mobile phone number, order information, etc.; 
-    communicate with existing and prospective customers about our products and services: we will collect your title, mobile phone number, order information, etc.; 
-    conduct promotions and competitions: we will collect your nickname, mobile phone number, delivery address, order information, etc.; 
-    conduct market research: we will collect your mobile phone number and contact information etc.; 
-    process and assess job applications: we will collect your name, contact information, educational background, qualifications and experience, etc.;
-    Execute agreements between you and us: we will collect the recipient’s name, delivery address, mobile phone number, email address, post code, etc. ; 
-    Keep you informed about our latest activities, products and services: we will collect your mobile phone number and email address etc.; 
-    allow you to join and participate in the SCS or Swarovski Club programs or other similar Swarovski-related memberships and conduct cross-channel account management, such as providing information about special offers, help and advice on products and services, providing invitations to special events or promotions, etc.: we will collect your nickname, title, mobile phone number, gender (optional), date of birth (optional), etc. If you log in to the Website using a third-party platform account, you authorize us to collect your third-party platform account information (including account number, account nickname, mobile phone number, OpenID, UID and profile photo, etc.); 
-    operate our business effectively and improve our products and services: we will collect information about your frequently used devices, such as browser type and version, app list, and in-app events. We will conduct data analysis and research in order to understand how you interact with us.

If you provide us with any third person’s personal information (including his/her name, telephone number and address, etc.) in the course of buying our products or using our services, you should ensure that you have lawful authorization or express consent to provide such party’s personal information (including name, telephone number and address, etc.), and guarantee that such information is true, accurate and not misleading.

Disclosure: In carrying out our business, it may be necessary to provide information about you to our third-party partners, which may include: 1) payment agencies: in order to fulfill your order, we need to provide your order number and order amount to WeChat, Alipay or China UnionPay etc., to enable them to confirm your payment instruction and complete the payment process; 2) logistic service providers: in order to fulfill your order, we need to share the recipient’s name, delivery address, mobile phone number and post code (optional) provided by you with SF Express to provide delivery services for you; and 3) other independent third-party data processors. Third party recipients who use personal information for legal reasons or as a result of a merger/acquisition. If Swarovski or its assets are acquired by or merged with another company, we will share your personal information with any of our legal successors.

5.    Entrusted Processing
We use a range of service providers to help us maximize improve the quality and efficiency of our services and our business operations. The service providers are entrusted by Swarovski to process your personal information according to Swarovski’s instructions. We will sign strict agreements with our service providers, requiring them to process your personal information in accordance with applicable laws, contracts, our requirements, this Privacy Policy, and any other relevant confidentiality and security measures.

6.    Using Your Personal Information for Marketing 
We may use the personal information you have provided to us (e.g., email address, telephone number, purchase history, social media interactions, etc.) to provide you with information in relation to new or updated products or services or special offers, promotions or competitions that may be of interest to you (including cross-channel communications). We will only do so in accordance with applicable laws or with your prior consent.

7.    Cross-Border Transfer of Your Personal Information 
We hereby remind you that all data described in the Privacy Policy is stored in a central customer database, which is operated by our affiliated company, D. Swarovski KG, Swarovski strasse 30, 6112 Wattens, Austria on behalf of Swarovski and in accordance with Swarovski’s instructions. Please click here for a detailed list of overseas recipients. The list may be updated and adjusted from time to time in response to new service needs and adjustments to legal entities and business functions. Swarovski ensures compliance with the applicable personal information protection laws.

In order to deliver products and services to you and to improve our products and services, we may sometimes disclose your personal information to affiliate companies within the Swarovski group or other third-party partners (including but not limited to entities located in Switzerland, the United States, Liechtenstein and Austria). 

We hereby remind you that when transferring your personal information to other countries or regions abroad for the above purposes, we guarantee that your data will receive the same level of protection. Data transfer to third countries will always be carried out in accordance with applicable Chinese laws and regulations, and we will take any other necessary measures to ensure the security of the personal information transferred. 

8.    Your Rights
Access to Your Personal Information: You have the right to access your personal information held by Swarovski, subject to exceptions provided by laws and regulations.

Correct Your Personal Information: When you find that there are errors in your personal information processed by us, you have the right to ask us to make corrections or supplements. You may make corrections on your profile page or contact us by using our contact information as listed above for such corrections.

Delete Your Personal Information: If you wish to have your personal information deleted, please let us know in the same manner as referred to above and we will take all reasonable steps to delete it unless we need to keep it for legal, audit or internal risk reasons. 
 
Transfer Your Personal Information: You have the right to request us to transfer your personal information to your designated personal information processor when you need to do so, subject to the relevant conditions.

Respond to Your Requests to Exercise Your Rights: To exercise your rights as set forth in this Section, you may contact us using our contact information published at the beginning of this Privacy Policy. We will verify your identity upon receipt of your request. If the request is made by someone other than you, the request may be reasonably declined if you do not provide evidence to prove that or we cannot verify that the person is legitimately making the request on your behalf. In principle, we do not charge any fee, unless your request is repeated many times and exceed the reasonable limit, in which case we will charge a cost fee as appropriate. Under the following circumstances, we will not be able to respond to your requests in accordance with laws and regulations: 
    They are related to national security or national defense security; 
    They are related to public security, public health or major public interests; 
    They are related to criminal investigations, prosecutions, trials and execution of judgments, etc.; 
    There’s sufficient evidence the subject of any personal information holds any ill will or abuses power; 
    Responding to your request may cause serious damage to the legitimate rights and interests of you or other individuals or organizations; 
    They involve any trade secrets.

9.    Storage and Security of Your Personal Information 
Swarovski will endeavor to take all reasonable steps to keep secure any information which we hold about you, and to keep this information accurate and up to date. We will use your personal information for as long as necessary to satisfy the purposes for which we collect your personal information (as described in Section 4 above), unless it’s necessary to extend the retention period or such extension is required or permitted by applicable law. After the retention period, we will delete or anonymize your personal information as required by applicable law.  

Unfortunately, however, no data transmission over the Internet can be guaranteed secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us through our Website, and you use our Website at your own risk.

Your personal information is stored on secure servers. We require our employees and data processors to respect the confidentiality of any personal information held by Swarovski.

Under the following circumstances, we can collect, use, process, share, transfer and publicly disclose your personal information without your prior consent:

    They are related to public security, public health or major public interests;

You can play an important role in keeping your personal information secure by maintaining the confidentiality of any passwords and accounts used on our Website. You are responsible for the security of your username and password (or other login information), and it is your responsibility to ensure the confidentiality of this information.

Swarovski provides access to third party websites through our Website. These linked websites are not under the control of Swarovski, and we are not responsible for the content or the conduct of the organization accessed via a link on our Website. Before disclosing your personal information on any website, we suggest you examine the terms and conditions and privacy policy of that website. 

12.    What to Do if You Have a Problem, Question or Complaint 
You have the right to raise any questions, comments or complaints about this Privacy Policy or our privacy practices, or you may file a lawsuit with the competent people’s court in the place where we are located (Huangpu District, Shanghai) according to law.  

In most cases, we will ask that you put your request in writing to us. We will investigate your complaint and will use reasonable endeavors to respond to you within 30 days of receiving your written complaint. If we fail to respond to your complaint within 30 days upon receipt of your written complaint or if you are not satisfied with our response, you have the right to file a complaint with the competent authorities in China.

Swarovski will review and revise its Privacy Policy from time to time. Whilst Swarovski seeks to minimize changes to our Privacy Policy, Swarovski reserves the right to change our Privacy Policy at any time by posting an updated version on our Website. Therefore, please keep checking the policy to ensure you are aware of the current terms. If Swarovski decides at any time to use your personal information in a manner materially different from that stated at the time it was collected, we will notify you by email or via a prominent notice on our Website, and we will seek your prior consent if necessary.
